Terms of Service & End User License Agreement

These Terms of Service and End User License Agreement (together, the “Terms”) are a binding agreement between you and TruCult (“TruCult”, “we”, “us”), the operator of the TruCult mobile applications and websites (the “Service”), governing your access to and use of the Service. TruCult is a social platform: it hosts communities (“cults”), channels, posts, comments, direct messages, trade journals, and other content created by users rather than by us. By creating an account, logging in, or otherwise using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Who we are and what the Service is

TruCult lets creators run communities around their expertise — trading, music, and other verticals — with free and paid channels, community posts, direct messages, and TruTrack, a journal where creators record and showcase trades (each record, a “TruTrade”). We provide the platform; the communities, their content, and any paid offerings within them are created and operated by independent users.

2. Eligibility & accounts

You must be at least 18 years old, or the minimum age required in your country if that is higher, to hold an account. You must confirm this during registration. Providing a false confirmation is a breach of these Terms and grounds for termination.

One person, one account. You are responsible for your account, for everything done through it, and for keeping your credentials secure — notify us at assist@trucult.app immediately if you believe your account has been compromised. Creating a cult additionally requires a valid invite code. You may not create an account if we have previously terminated yours, and you may not buy, sell, rent, or transfer an account or invite code.

Account information you provide must be accurate and kept current. Usernames are allocated first-come, first-served, but we may reclaim a username that infringes someone else’s rights, impersonates a person or brand, or squats on a name in bad faith.

3. Not financial advice

TruCult is a platform for creator-led communities. Content on the Service — including TruTrades and TruTrack statistics, messages, posts, and creator commentary — is for informational and educational purposes only and is not investment, financial, legal, or tax advice, and is not an offer or solicitation to buy or sell any security or instrument.

• Creators are independent. They are not our employees, agents, or representatives, and they do not act on our behalf. We do not verify, endorse, or supervise creator commentary, credentials, or claimed results.
• No execution, no copy trading, no managed accounts. The Service does not place, route, or execute trades, does not connect to your broker, and does not copy anyone’s trades into your account. Nothing on the Service is a regulated advisory, portfolio-management, or broking service.
• No guaranteed returns. Trading and investing involve risk, including the possible loss of all capital. Past performance — including any TruTrack record — does not guarantee future results. Any content promising assured or guaranteed returns violates these Terms; report it.
• Your decisions are your own. You are solely responsible for evaluating any content and for every financial decision you make. Consult a licensed professional before acting on anything you read here.

4. Your content and who can see it

You retain ownership of content you create (“User Content”). You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt (for formatting and delivery), display, and distribute your User Content as needed to operate, improve, and promote the Service. This license ends when you delete the content or your account, except for copies retained in backups, for legal compliance, for moderation and audit records, or where others have already re-shared it.

You are responsible for what you post and must have the rights to share it. Think before you post: content in a cult’s home channel and on a cult’s public page may be visible to anyone, including people without a TruCult account. Content in a paid or private channel is visible to its members. Direct messages are visible to the people in the conversation. We cannot control what recipients do with content once they can see it, including copying or screenshotting it, and media shared in direct messages is purged on a schedule rather than guaranteed to be unrecoverable.

We do not claim ownership of your ideas, strategies, or trade records, and posting them does not transfer them to us or to other users. Feedback you send us about the Service may be used without obligation to you.

5. Creator responsibilities

If you run a cult, a channel, or a paid offering, you additionally agree that you will:

• Hold whatever registrations or licences the law of your jurisdiction requires for what you actually do, and not describe your offering in ways that imply a licence, regulatory status, or affiliation you do not have.
• Record TruTrades honestly. Fabricating, backdating, or selectively deleting trade records to inflate a track record is deceptive conduct under Section 6 and grounds for termination.
• Moderate your community: remove content in your channels that violates these Terms when you see it, and not encourage or reward behaviour that violates them.
• Honour what your members paid for: deliver the access and content your paid channels and services describe, at the cadence they describe.
• Comply with tax obligations on your earnings. Payout details you provide us must be accurate and belong to you.

6. Acceptable use & community rules

We have zero tolerance for objectionable content and abusive users. You agree not to post, send, or share content, and not to behave in any way, that:

• Sexually exploits or endangers a minor in any way. This is an absolute prohibition; see our Child Safety Standards.
• Is pornographic or sexually explicit, or contains nudity or sexually suggestive material.
• Is hateful, or attacks or demeans a person or group based on race, ethnicity, national origin, caste, religion, disability, disease, age, sex, gender identity, or sexual orientation.
• Harasses, bullies, threatens, stalks, or intimidates any person.
• Depicts or glorifies graphic violence, gore, cruelty, terrorism, or violent extremism, or encourages self-harm, suicide, or eating disorders.
• Reveals another person’s private information — address, phone number, identity documents, financial details — without their consent.
• Is unlawful, fraudulent, or deceptive, or promotes illegal goods, drugs, or weapons.
• Impersonates any person or entity, or misrepresents your affiliation or credentials.
• Runs scams, pump-and-dump schemes, front-running, guaranteed-return claims, unlicensed advisory services, or other manipulative or misleading financial conduct.
• Infringes intellectual property, privacy, or publicity rights.
• Is knowingly false or misleading in a way that could cause harm, or presents synthetic or manipulated media — including AI-generated images, audio, video, or fabricated screenshots and track records — as if it were real.
• Organises or joins pile-ons, mass reporting, or coordinated harassment of a person or community.
• Is spam, bulk unsolicited messaging, or engagement manipulation.
• Distributes malware, scrapes or harvests data, uses bots or automated access, reverse engineers the Service, or attempts to disrupt it or gain unauthorized access.
• Circumvents any safety, moderation, payment, or access control — including evading the content filter, a block, a suspension, or a paid-access gate.

7. Using TruCult responsibly

Beyond the prohibitions above, we expect members to behave the way a good community expects:

• Disagree with the argument, not the person. Heated debate about markets is welcome; contempt for the people making it is not.
• Report, don’t retaliate. If someone breaks the rules, use the report and block tools rather than answering in kind — retaliation is itself a breach.
• Be honest about who you are and what you have done. Do not inflate results, borrow someone else’s track record, or imply credentials, licences, or regulatory status you do not hold.
• Respect other people’s privacy. What is shared in a paid channel or a direct message is not yours to republish.
• Remember who may be reading. TruCult is an 18+ service, and content that is harmful, exploitative, or otherwise violates these Terms does not belong here.

The Service is a place to learn and discuss, not a substitute for professional advice or for managing your own risk. Take breaks, and do not make financial decisions on the strength of a message from a stranger.

8. Reporting, blocking, and how we moderate

Every post, comment, channel message, direct message, profile, community, and service on the Service can be reported from within the app. Reports go to our moderation queue.

We act on valid reports of objectionable content within 24 hours by removing the content and, where warranted, suspending or terminating the account responsible. Suspension is enforced by our servers: a suspended account cannot post, comment, or message. Some removals happen automatically: content is screened for prohibited language when it is posted, and a post or comment reported by more than one person is hidden immediately pending review. Every moderation action is recorded with a timestamp in an audit log.

You can block any user. Blocking prevents them from contacting you, removes their posts, comments, and messages from your view immediately, and notifies us so we can review their conduct. You can manage blocks at Settings → Blocked accounts.

We may remove content, limit visibility, suspend, or terminate accounts at our discretion, with or without notice, to enforce these Terms or protect users. If you believe we removed something in error, email assist@trucult.app and we will review it. Where the law requires, we may also preserve and disclose content and account information in response to valid legal process.

9. Intellectual property

The Service — including its software, design, wordmarks, and everything on it other than User Content — is owned by us or our licensors and protected by intellectual-property law. These Terms do not grant you any rights to our trademarks or branding.

If you believe content on the Service infringes your copyright or trademark, email assist@trucult.app with: identification of the work, a link to the content, your contact details, a statement that you believe in good faith that the use is unauthorized, and a statement that the information is accurate. We remove infringing content and terminate repeat infringers. If your content was removed and you believe that was a mistake, you may send a counter-notice to the same address.

10. Paid access, subscriptions & payments

Some cults, channels, and services offer paid access. Prices, billing periods, and renewal terms are shown at the point of purchase. Purchases are made on our website; payments are handled by third-party payment providers subject to their terms, and we do not store your full card details. Paid access is granted to your account and is personal to you — sharing gated content outside the channel it was purchased in is a breach of these Terms.

• Subscriptions. A subscription grants access for the billing period shown at purchase. Where renewal applies, the renewal price and period are shown before you pay, and we notify you before a renewal falls due. You can stop a subscription renewing at any time; access then runs to the end of the paid period.
• Refunds. Except where required by law or a platform’s rules, payments are non-refundable. Suspension or termination of your account for a breach of these Terms does not entitle you to a refund of amounts already paid.
• Creators set their offerings. We are not a party to the underlying relationship between a creator and their members beyond providing the platform, and we do not guarantee any outcome from paid content.
• Taxes. Prices may include or exclude applicable taxes as shown at the point of purchase; you are responsible for taxes the law places on you.

11. Termination

You may stop using the Service and delete your account at any time from Settings → Delete account (or via this page). Deleting your account removes your content and any cults you own. We may suspend or terminate access if you violate these Terms, if the law requires it, or to protect the Service and its users. Sections that by their nature should survive termination — including 3, 4 (the backup/audit tail), 9, and 13 through 16 — survive it.

12. Third-party content, services and links

The Service contains content created by other users and links to third-party sites and services we do not control. We are not responsible for that content, and including it is not an endorsement. Third-party services you use through or alongside the Service — payment providers, app stores, brokers, exchanges — have their own terms, which govern your relationship with them.

13. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement — to the maximum extent permitted by law. We do not guarantee that the Service will be uninterrupted, secure, or error-free, that any information on it is accurate, that any creator’s content or record is genuine, or that moderation will catch every piece of objectionable content before you see it.

14. Limitation of liability

To the maximum extent permitted by law, TruCult and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; for any loss of profits, data, goodwill, or opportunity; or for any trading or investment losses arising from your use of the Service or reliance on any content on it — even if we were advised of the possibility. To the same maximum extent, our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose and ₹5,000. Nothing in these Terms excludes liability that cannot be excluded by law.

15. Indemnity

You agree to indemnify and hold TruCult harmless from claims, losses, and expenses (including reasonable legal fees) arising from content you post, your use of the Service, your paid offerings as a creator, or your breach of these Terms or of applicable law.

16. Governing law & disputes

These Terms are governed by the laws of India, and the courts at the seat of TruCult’s operations in India have exclusive jurisdiction over disputes arising out of them, subject to any mandatory consumer-protection rights the law of your place of residence gives you. Before filing a claim, contact us at assist@trucult.app — most disputes can be resolved informally, and we will try in good faith for 30 days.

17. Mobile application license (EULA)

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the TruCult app on devices you own or control, for your personal, non-commercial use, subject to these Terms and to the usage rules of the app store you obtained it from. You may not copy, modify, distribute, sell, lease, or sublicense the app, or reverse engineer or attempt to extract its source code except where the law expressly permits.

For copies of the app obtained through the Apple App Store, the following also applies:

• Acknowledgement. These Terms are concluded between you and TruCult only — not with Apple Inc. (“Apple”) — and TruCult, not Apple, is solely responsible for the app and its content. Where these Terms grant less than Apple’s standard Licensed Application End User License Agreement, Apple’s minimum terms apply.
• Scope of license. Your license is limited to use of the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
• Maintenance and support. TruCult, not Apple, is responsible for any maintenance and support of the app. Apple has no obligation to furnish any maintenance or support services for it.
• Warranty. TruCult, not Apple, is responsible for any product warranties, express or implied, to the extent not disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
• Product claims. TruCult, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection or similar legislation.
• Intellectual property claims. In the event of a third-party claim that the app or your use of it infringes that third party’s intellectual property rights, TruCult, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of the claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data service agreement).
• Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms as they relate to your license of the app, and Apple has the right to enforce them against you as such.
• Developer contact. Questions, complaints, or claims about the app go to TruCult at assist@trucult.app.

For copies obtained through Google Play, your use is additionally subject to the Google Play Terms of Service, and Google is a third-party beneficiary of this license to the extent Google Play’s developer terms require.

18. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date. Where changes are material we will ask you to accept them again in the app. Continued use of the Service after changes take effect constitutes acceptance.

19. General

These Terms, together with the Privacy Policy and the Child Safety Standards, are the entire agreement between you and us about the Service. If any provision is held unenforceable, the rest remain in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them as part of a reorganisation or transfer of the Service. Nothing in these Terms creates a partnership, employment, or agency relationship between you and us. Notices to you may be given in the app or to the email on your account.
